 1. GENERAL TERMS

  1. In accordance with the requirements of the Act on Electronic Services, Artur Gilbert running a business under the name of: CSB Artur Gilbert, entry to the Central Registration and Information on Economic Activity of the Republic of Poland carried out by the relevant economy Minister, ul. Stara 14, 05-092 Łomianki, Poland, NIP (tax ID number) 5632044804, REGON (statistical number) 140839429, e-mail: info@craftstudiobeads.eu, telephone number: 22 797 411 044, hereinafter ‘Craftstudiobeads’ or ‘Seller’, hereby establishes the following terms and conditions for the online shop through the website available on the Internet: www.craftstudiobeads.eu (hereinafter ‘Terms and Conditions’).
  2. These Terms and Conditions hereby determine the terms of sale, rules and technical conditions for the use of the online shop Craftstudiobeads.eu (hereinafter ‘Online Shop’) through the website available on the Internet: www.craftstudiobeads.eu.
  3. Each customer is obliged to read the following Terms and Conditions before using the Online Shop.
  4. These Terms and Conditions are available free of charge via the Online Shop’s website at www.craftstudiobeads.eu, in the form, which enables its downloading, saving and printing.
  5. Each customer is bound by these Terms and Conditions from the moment of taking the actions aimed at using the Online Shop’s website.
  6. Each customer is obliged to comply the prohibition of providing the content that is unlawful.

2. DEFINITIONS

The terms used herein shall have the following meaning:

Personal Data Controller – Artur Gilbert running a business under the name of: CSB Artur Gilbert, entry to the Central Registration and Information on Economic Activity of the Republic of Poland carried out by the relevant economy Minister, ul. Stara 14, 05-092 Łomianki, Poland, NIP (tax ID number) 5632044804, REGON (statistical number) 140839429, e-mail: info@craftstudiobeads.eu, telephone number: 22 797 411 044, who determines the aims and means of the processing of personal data of the customers.

Working days – days of the week from Monday to Friday, with the exception of public holidays.

Customer Service – is a separate organizational unit of the ‘Seller’, which is responsible for the contact with the customers in order to agree the conditions of the order execution or the complaint procedure. Customer Service is available under the telephone number: 22 797 411 044 and e-mail:info@craftstudiobeads.eu.

Delivery Document – is a document issued to the Customer by the Supplier of the ‘Seller’ at the moment of receiving the Products or Goods by the Customer, which include the data about the ordered ware, nett price, gross price, VAT rate and the amount of the ordered wares, and the total value of the order.

Delivery – is providing by the ‘Seller’ the Goods or Products specified in the Order to the Customer, which means that the ‘Seller’ provided the performance under a sale Contract. The delivery may be managed by the Seller via self-owned transport or via using the services of the external third-party supplier (courier, Poczta Polska - Polish Post, or other chosen by the Seller).                               

Supplier – the Seller’s employee, who delivers the Goods and Products described in the Order to the address given by the Customer, and also the entity, with whom the Seller works considering the Good deliveries.

Password – the sequence of the letters, numbers or other symbols set and known only by the Customer, which gives the Customer the access to the Customer’s Account in the Online Shop.

Customer – a natural person of age, who has full capacity to perform legal actions or a legal entity or an organizational unit, which but to which special regulations grant legal capacity, who places an Order in the Online Shop.

Customer’s Account – an online resource of the Online Shop, to which the Customer has an access. Functions installed in the Customer’s Account enables placing and Order freely in the Online Shop.

Login – an individual, given by the Customer and individualising e-mail address, required along with the Password to place an Order in the Online Shop via the Website.

Registration – a set of activities concerning the correct filling an on-line form on the Website by the Customer.

Online Shop – an online shop Craftstudiobeads run by Artur Gilbert running a business under the name of: CSB Artur Gilbert, entry to the Central Registration and Information on Economic Activity of the Republic of Poland carried out by the relevant economy Minister, ul. Stara 14, 05-092 Łomianki, Poland, NIP (tax ID number) 5632044804, REGON (statistical number) 140839429, e-mail: info@craftstudiobeads.eu, telephone number: 22 797 411 044, hereinafter ‘Craftstudiobeads’ or ‘Seller’, available on the Website: www. craftstudiobeads.eu.

Seller, Provider – Artur Gilbert running a business under the name of: CSB Artur Gilbert, entry to the Central Registration and Information on Economic Activity of the Republic of Poland carried out by the relevant economy Minister, ul. Stara 14, 05-092 Łomianki, Poland, NIP (tax ID number) 5632044804, REGON (statistical number) 140839429, e-mail: info@craftstudiobeads.eu, telephone number: 22 797 411 044, hereinafter ‘Craftstudiobeads’ or ‘Seller’, who is the owner of the Online Shop.

Patron – a person, who buys at the Online Shop at least once every three months.

Website – a website, on which the Online Shop Craftstudiobeads is available, working under www. craftstudiobeads.eu.

Information and communication system – a set of cooperating information technology facilities and software, which provides storage, processing, uploading and downloading the data via telecommunications networks by means of a terminal appropriate for the given type of network.

Wares or Products – products presented on the Website of the Online Shop, which can be ordered by the Customer.

Service - service provided by the Seller to the Customer in accordance to these Terms and Conditions.

Newsletter - the Seller sends to the Customer’s e-mail address expressly specified information about new products or services offered by the Seller.

Sale contract – an agreement for the sale concluded by Craftstudiobeads and the Customer of the Online Shop in accordance to the conditions and procedures specified in these Terms and Conditions.

Act on personal data protection - the act of the Polish law of 29 August 1997 on personal data protection (Dz.U. 2002, No. 101 item 926 with later amendments).

Act on Copyrights and Related Rights - the act of the Polish law of 4 February 1994 on copyrights and related rights (consolidated text: Dz.U. 2006, No. 90 item 631, with later amendments).

Act on Electronic Services - the act of the Polish law of 18 July 2002 on electronic services (Dz.U. 2002, No. 144 item 1204 with later amendments).

Order, Order Form – means that the Customer makes an offer to the Seller to purchase the chosen Products presented on the Website of the Online Shop in accordance to the conditions specified in these Terms and Conditions.

3. SERVICES PROVIDED VIA THE WEBSITE OF THE ONLINE SHOP

  1. The Seller provides the following services via the Website of the Online Shop:

1.1.   selling the Goods presented on the Website of the Online Shop;

1.2.   selling the Goods made on a special order of the Customer with respect to the Product range of the Seller available on the Website of the Online Shop;

1.3.   setting an Customer’s Account free of charge;

1.4.   sending a Newsletter to the Customer free of charge;

  1. The Seller is entitled to publish on the Website of the Online Shop information about the sales concerning the services provided.
  2. The charges amended by the Seller due to the Selling the Goods are determined by the price presented with each Good on the Website of the Online Shop.

4. TECHNICAL CONDITIONS

  1. In order to use the Online Shop fully and correctly, the Customer shall have:

1.1.   a device which has the access to the Internet;

1.2.   an Internet browser version at least Internet Explorer 11 or Chrome 39, or FireFox 34, or Opera 26, or Safari 5, or latest, supporting cookies;

1.3.   an active e-mail account;

1.4.   a working graphics card (display colours).

  1. Using the Online Shop may depend on installing Java, Java Script and accepting cookies.
  2. The Customer, whose information and communication system does not fulfil the conditions specified in IV, is not entitled to lay claims on account of inability to use the Online Shop.

5. SETTING UP THE CUSTOMER’S ACCOUNT

  1. To set up the Customer’s Account, the Registration is required.
  2. Registration is free of charge and is essential to place an Order in the Online Shop via the Website.
  3. By Registration the Customer:

3.1.   fills the data concerning: name and surname, e-mail address, date of birth;

3.2.   sets the individual Password;

3.3.   is requested to read and accept these Terms and Conditions;

3.4.   gives the consent to the processing of personal data in accordance to the Act on personal data protection;



3.5.   may give the consent to receiving commercial offers from the Seller’s Partners.

  1. The contract concerning the Customer’s Account Service is concluded at the moment of activating the Customer’s Account on the Website of the Online Shop.
  2. By filling the Registration form the Customer gives the consent to receiving the information concerning the shopping done by the Customer in the Online Shop via the e-mail address given by the Registration. To the e-mail address given by the Customer the Seller sends also the information confirming the Registration in the Online Shop and the Customer’s Account becomes accessible to the Customer.
  3. The Customer may log into the Customer’s Account at any moment by using the Login and the Password.
  4. Via the Customer’s Account, the Customer is entitled to:

7.1.          do shopping in the Online Shop

7.2.         receiving the information from the Seller about the Services and sales concerning the Seller’s offer (Newsletter);

7.3.          changing the date given by the Customer during the Registration process, including the Login and the Password.

  1. The Customer is responsible for the safety and proper use of the Login and the Password, which shall be kept confidential. If any suspect finding indicating that the Login or the Password is held by an unauthorised person occurs, the Customer shall be obliged to inform the Seller immediately. The Seller shall not be liable for the damages resulting from releasing the Login or Password to unauthorised persons by the Customer.
  2. Customer’s Account Service is free of charge for an indefinite period of time. The Customer may at any moment and without providing any reason request a removal of the Customer’s Account by sending an appropriate request to the Seller via e-mail to: info@craftstudiobeads.eu od in writing to: CSB Artur Gilbert ul. Stara 14, 05-092 Łomianki, Poland. As the request is received, the Seller removes the Customer’s Account immediately, no later than 3 days after receiving the request.

6. GENERAL CONDITIONS OF USE

  1. The Seller sells the Goods via the Internet.
  2. The Seller sells the Goods in the Republic of Poland, European Union Member States and non-EU countries.
  3. Information concerning the Products for sale (for instance descriptions of Products) that were posted on the Website of the Online Shop is created by the Producer or the Seller. Before buying the Product the Customer shall read its description posted on the Website of the Online Shop. Before using the Product, which is provided with information from the Producer on the packaging, the Customer shall read information provided by the Producer on the packaging.
  4. The prices presented on the Website of the Online Shop are the gross prices (VAT included in accordance to the current VAT rate), in PLN and do not include any information about delivery costs and any other costs, which shall be paid by the Customer due to the sale Contract and of which the Customer shall be informed while choosing the Delivery and placing an Order.
  5. The given prices are binding at the moment of placing an Order.
  6. The Seller may change the prices of the Wares, which are available in the Online Shop and may conduct and call off promotional campaigns and sales of any kind subject to VI point 5 of these Terms and Conditions.
  7. The Order placed by the Customer shall constitute an offer, in the understanding of the civil code. By sending an e-mail confirming the Order to the Customer, the Seller thereby accepts an offer to the practicable extent.
  8. The sale Contract is concluded between the Customer and the Seller at the point, where the Customer receives the confirmation of the Order sent by the Seller.
  9. The sale Contract is concluded at the Seller's corporate location.
  10. The Seller attaches great importance to providing to the Customer the confidentiality at the time of taking any actions concerning the use of the Online Shop.
  11. The Customer shall be obliged to use the Online Shop in accordance with the rules of national law, the conditions of these Terms and Conditions and the principles of morality.
  12. It is forbidden to use the Online Shop in such a way that might violate third party personal rights and posting or disseminating via Online Shop any contents that are vulgar, false or violating third party personal rights, law or any other legitimate interest of the Seller or third party.
  13. The Customer may use the Online Shop resources for the personal use exclusively.
  14. It is not allowed for the Customer to use the resources and functions of the Online Shop for commercial purposes or for purposes which would affect the Seller’s interests.

7. ORDER

  1. To place an Order the Customer choses the Products presented in the Online Shop, then places them in the virtual shopping cart by clicking the button: ‘Add to cart’.
  2. For the entire duration of shopping the Customer may check the contents of the shopping cart and control the value of the Order.
  3. The Customer may cancel the Order after adding a Product to the virtual shopping cart by clicking the ‘X’ button.
  4. Once the Customer is decided to buy, he/she may place the Order via the Customer’s Account. The Customer shall be redirected to the log in form, where the Login and the Password shall be typed or the Customer shall be given an option to Register the Customer’s Account.
  5. Once logged in, the Customer chooses the Delivery, the mean of payment and the Delivery address.
  6. In the next step, the Customer shall be redirected to the virtual checkout, where by clicking the button ‘Place the order and pay’ the Order is sent to the e-mail address of the Shop.
  7. Then, the Seller confirms receiving the Order by sending the message to the Customer’s e-mail address. The Customers are additionally informed of the total value of purchased items (nett and gross) and of any additional costs, if any.
  8. In accordance to IX of these Terms and Conditions, the Seller shall proceed with performance of the Order as soon as the payment is made by the Customer.
  9. Orders can be placed throughout the whole day, for the whole calendar year. The Seller reserves the right to suspend the order performance during holidays or public holidays and other chosen days, which does not affect the Orders that were placed before the information about days off is provided by the Seller. Information about suspending the order performance shall be provided on the Website.
  10. The Customer may check in the presence of a supplier if the delivered Good is consistent with the placed Order. If any damages or impaired functions of the delivery are detected, the Customer may request an appropriate protocol of this fact.
  11. Order Form Service is free of charge, has a one-off nature and ends at the moment of placing the Order via the above mentioned form, or at the moment of resignation from placing the Order via the form by the Customer.

8. DELIVERY

  1. The Seller delivers in the Republic of Poland, and other countries (the European Union Member States and non-EU countries).
  2. The Delivery of the Products is charged, unless otherwise provided in the sale Contract.
  3. The Delivery costs are presented on the Website of the Online Shop and at the moment of placing the Order, and also at the moment of expressing the will to conclude the sale Contract.
  4. The Seller shall be obliged to deliver the Good under a contract without any defects.
  5. The Seller delivers the Product to the Customer within 14 working days in the Republic of Poland, within 21 days in the European Union Member States, and up to 30 days in other countries, unless otherwise provided by placing the Order.
  6. Date from which the Delivery time begins to run counts from the date of crediting the Seller’s bank account or current account.
  7. The ordered Goods shall be delivered to the Customer by the Supplier to the address provided in the Order Form. On the day of sending the Order on the Customer’s e-mail address the Seller shall send a message confirming the postage.
  8. The Seller shall attach to the Delivery the sale document confirming the items included in the Order. In the case of VAT invoices, the Customer authorizes the Seller to issue an invoice without a signature of the consignee.
  9. Unjustified refusal to accept the Delivery by the Customer is treated as a violation of these Terms and Conditions.
  10. In the case of the absence of the Customer at the given address, the Supplier’s employee shall leave a note or shall try to contact the Customer by phone to set the date, when the Customer is present. The Seller shall not be responsible for any obstacles to the Delivery caused by the Customer.

9. PAYMENTS

  1. The Customer may pay for the ordered Goods by:

1.1.   transfer to the Seller’s bank account;

1.2.   transfer performed by the entity, which cooperate with the Seller - (online payment).

  1. The Customer shall be obliged to pay within 7 days counting from the date of concluding the sale Contract.

10. WARRANTY AND COMPLAINT PROCEEDINGS

  1. The Seller shall be obliged to deliver the Good free from material defects and title defects to the Customer and shall remain liable to the Customer if the Good has any material or title defect.
  2. As the Seller’s Supplier performs the Delivery and it transpires to be inconsistent with the Order, the Customer shall inform the Supplier and shall not accept the Products that were not ordered.
  3. Shall the Good be damaged or the Product shall be delivered with a factory defect, the Customer may refuse to accept such a Product by signing an appropriate statement.
  4. Shall the Good have any defect, the Customer may:

4.1.   make a statement to reduce the price or to withdraw from the sale Contract, unless the Seller eliminates the defect or replaces the damaged Good to the one free from any defects immediately and without any inconveniences for the Customer. This restriction shall not apply to the Good that have already been replaced or fixed by the Seller or when the Seller did not meet the obligation to eliminate the defects or to replace the Good to the one free from any defects. The Customer instead of having the defect eliminated may request the replacement of the Good to the one free from defects or instead of replacing the Good may request the elimination of the defect, unless it is impossible to bring the goods into conformity with the sale Contract in the way chosen by the Customers or it would require excessive costs in comparison to the way chosen by the Seller. By estimating the excessive costs the value of the Good that is free form defects is taken into consideration, as well as kind and meaning of the defect and the inconveniences that may appear to the Customer while

4.2.   requesting the replacement of the Good to the one free from damages or elimination of the defect. The Seller shall be obliged to replace the damaged Good to the one free from any defects or to eliminate the defect in reasonable time without excessive inconveniences of the Customer. The Seller may refuse to answer the Customer’s requests if bringing the goods into conformity with the sale Contract of the damaged Good in the way chosen by the Customer is impossible or in comparison to the other possible way of bringing the goods into conformity with the sale Contract would require excessive costs. The Seller shall bear the repair or replacement costs.

  1. The Customer, who exercises rights under statutory warranty, shall be obliged to deliver the damaged product to the Seller’s address and the Seller shall bear the delivery costs.
  2. The Seller shall be responsible for any warranty claims if the physical defect is observed before elapse of two years from releasing the Good to the Customer. The request to eliminate the defect or replace the Good to the one free from any defects shall be subject to a time-limit of one year, however this period shall not end before the expiry of the period mentioned in previous sentence. In this period the Customer may withdraw from the sale Contract or make a statement to reduce the price due to the damaged Ware. Shall the Customer request the replacement of the Good to the one free from any damages or the elimination of the defect, the period in which the Customer may withdraw from the sale Contract or make a statement to reduce the price starts at the moment of ineffective expiry of the term of replacing the Good or eliminating the defect.
  3. All claims and requests shall be filed at the Seller’s e-mail address: info@craftstudiobeads.eu or in writing by registered letter at: CSB Artur Gilbert ul. Stara 14, 05-092 Łomianki, Poland.
  4. The correct request shall include at least the Customer’s data (including name, surname, address, e-mail address) and the description of a problem giving rise to the complaint.
  5. The Seller shall consider the complaint within 14 days after the date of receiving the request. The Seller shall immediately notify the Customer filing the request about the result via e-mail to the Customer’s e-mail address.
  6. The Customer, who is a consument shall have the following recourse to an out-of-court complaint and redress mechanism:

10.1.   The Customer shall be entitled to refer to the Permanent Consumer Arbitration Court, referred to in the Article 37 of the Act of 15. December 2000 of the State Trade (Dz.U. 2001 No. 4 item 25 with amendments), with a request to resolve any dispute arisen from the sale Contract;

10.2.   The Customer shall be entitled to refer to the Inspector of the Trade Inspectorate, in accordance to the Article 36 of the Act of 15. December 2000, of the State Trade (Dz.U. 2001 No. 4 item 25 with amendments), with a request for the conduct of a mediation procedure for an amicable settlement between the Customer and the Seller;

10.3.   The Customer may receive free legal assistance in dispute settlement proceedings between the Customer and the Seller, use also free assistance from The District (Municipal) Consumer Ombudsman or a community-based organisation, whose statutory work includes the protection of consumers (i.a Consumers' Association, Association of Polish Consumers);

10.4.   The Customer may via http://ec.europa.eu/consumers/odr use the ODR platform, which provides an online assistance in dispute settlement between Customers and EU-level entrepreneurs. There is a Multilanguage Website, which can be used by the Customers and Entrepreneurs, who are interested in out-of-court settlement of the dispute concerning contractual obligations, resulting from the Internet sale contracts or contracts on provision of services.

11. THE RIGHT OF WITHDRAWAL FROM THE CONTRACT

  1. The Customer, who is a consumer and has concluded a sale Contract, may withdraw from this Contract within 14 days without providing any reason, however that period shall be calculated from the date of receiving the Good by the Customer and if the contract:

1.1.   includes many products, which are delivered separately, in multiple lots or pieces, the mentioned period shall be calculated from the date of receiving the last product, lot or piece;

1.2.   includes delivering products regularly for a definite period of time - the mentioned period shall be calculated from the date of receiving the first product.

  1. The Customer may withdraw from the sale Contract by making a statement of withdrawal. The statement may be made on the form forming the attachment No. 3 to these Terms and Conditions. Sending the statement before this period expires, suffices to comply with the time limit. The Seller shall immediately confirm receiving the form submitted vie the Website.
  2. The withdrawal statement may be made:

3.1.      in writing to: CSB Artur Gilbert ul. Stara 14, 05-092 Łomianki, Poland.

3.2.      via e-mail to: info@craftstudiobeads.eu.

  1. Shall the Customer withdraw from the sale Contract, the Contract shall be considered not concluded, shall the Customer make a withdrawal statement before the offer has been accepted by the Seller, it ceases to be binding.
  2. The Seller shall immediately, no later than 14 days from the day of receiving the Customer’s withdrawal statement, the Seller shall reimburse all payments received from the Customer, including the Delivery costs. The Seller may withhold the reimbursement of the payments received from the Customer until the Seller has received the Good back or the Customer has provided the has supplied evidence of having sent back the Ware, whichever occurs earlier.
  3. Shall the Customer, who decided to withdraw from the contract, choose other than the cheapest way of Delivery offered by the Seller, the Seller shall be not obliged to cover any additional costs the Customer had incurred.
  4. The Customer shall be obliged to return the Good immediately to the Seller, but no later than 14 days from the day of the withdrawal. To suffice to comply with the time limit, the Customer shall send the Good to: CSB Artur Gilbert ul. Stara 14, 05-092 Łomianki, Poland - before this period of time expires.
  5. The Customer shall be liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the Ware.
  6. The Seller shall carry out the reimbursement using the same means of payment as the Customer used, unless the Customer has expressly agreed otherwise and which involves no financial cost to him/her.
  7. The right to withdraw from distance contracts is entitled to the Customers in case of the contracts:

10.1.   of providing services, if the Seller has fully provided the services ordered by the consumer, who has been informed before the Seller begins to provide services that after the performance of the service by the Seller, the Customer loses the right to withdraw from the contract;

10.2.   in which the price depends on fluctuations in the financial market outside the Seller’s control and which may occur during the withdrawal period;

10.3.   for the supply of Products which are liable to deteriorate or expire rapidly;

10.4.   for the supply of non-prefabricated Products, made on the basis of an individual choice of or decision by the Customer or to meet the Customer’s individualized needs;

10.5.   for the supply of Products contained in a sealed package, which due to health protection or hygiene considerations shall not be returned and the package has been opened after delivery;

10.6.   for the supply of Products by nature inseparably mixed with other items after delivery;

10.7.   for the supply of alcoholic beverages, the price of which has been agreed upon at the time of the conclusion of the sale Contract, the delivery of which can only take place after 30 days and the actual value of which is dependent on fluctuations in the market which cannot be controlled by the Seller;

10.8.   in which the Customer has specifically requested a visit from the Seller for the purpose of carrying out urgent repairs or maintenance. Where on the occasion of such a visit the Seller provides related services in addition to those specifically requested by the Customer or goods other than replacement parts necessarily used in performing the maintenance or in making the repairs, the right of withdrawal applies to those additional related services or Products;

10.9.   for the supply of sealed audio or video recordings or computer software and have been unsealed after delivery;

10.10.      for the supply of a newspaper, periodical or magazine with the exception of subscription contracts for the supply of such publications;

10.11.      which was concluded at a public auction;

10.12.      for the provision of accommodation other than for residential purpose, transport of goods, car rental services, catering or services related to leisure activities if the contract provides for a specific date or period of performance;

10.13.      for the supply of digital content which is not supplied on a tangible medium if the performance has begun with the Customer’s prior express consent and with the acknowledgement by the consumer of losing the right to withdraw;

12. RESPONSIBILITY

  1. The Seller’s liability towards the Customer for non-performance or inadequate performance the sale Contract shall be limited to the actual losses evidenced by the Customer, excluding benefits lost.
  2. The Seller shall not be responsible for:

2.1.   damage caused to third parties resulting from using the Online Shop by the Customer in a way contrary to these Terms and Conditions or the applicable law;

2.2.   the loss of Customer’s data resulting from external factors (such as cable breaks, failure of hardware or software) or from other causes beyond the control of the Seller;

2.3.   damages resulting from providing by the Customer incomplete or false information needed for performing the sale Contract;

2.4.   damages resulting from using the Shop by the Customer in a way contrary to these Terms and Conditions or the applicable law, especially from disclosing of the Login or Password, disclosing of the personal data;

2.5.   damages caused by disclosure of personal data in accordance with these Terms and Conditions and the applicable law;

2.6.   data provided by the Customers to the Online Shop;

2.7.   the functioning of the servers containing e-mails of the Customers, for blocking the e-mails sent by the Seller by servers administrators.

13. PATRONS

  1. The Seller considers discounts and special offers for the Patrons (Customers regularly using the Online Shop).
  2. Information concerning latest offers and discounts is presented on the Website of the Online Shop, on the social media apps (Facebook, Twitter, etc.) or on the homepage.

14. ADDITIONAL SERVICES

  1. The Seller provides the additional Newsletter services to the Customers.
  2. Additional services are free of charge, 24 hours a day, 7 days a week for an indefinite period of time.
  3. Additional services shall be dedicated to the Customers, who have provided their e-mail address, are Registered and have subscribed to the Newsletter by ticking the relevant box in the Order Form.
  4. The Newsletter service - the Seller sends to the Customer’s e-mail address expressly specified information about new products or services offered by the Seller.
  5. Each Newsletter includes information about the sender, the topic of the e-mail and information of about the possibility to resign from the Newsletter subscription service.
  6. The Customer may at any moment resign from the Newsletter subscription service. Resigning from the Newsletter subscription service is available under the link included in each sent Newsletter e-mail or via activating the relevant box in the Customer’s Account.

15. COPYRIGHT

  1. All proprietary rights, including copyrights to the content of the websites of the Online Shop are owned by the Seller and are protected by law.
  2. The Seller makes a provision that all content included in the Online Shop (especially graphics, texts and photos) shall enjoy the legal protection provided for especially in Act on Copyrights and Related Rights. The Customer only has the right to use them to the extent of permitted personal use. Copying, revising or distributing on the Internet and other forms of using the content presented in the Online Shop in a way that is not permitted under the applicable law is forbidden.
  3. The data and any other materials constituting content of the Online Shop, both those that are and are not subject of the copyrights, shall not be used for conducting any competitive business activity by the Customer towards the Seller.

16. FINAL PROVISIONS

  1. The Seller is authorised to unilaterally amend these Terms and Conditions. Amendments to the Terms and Conditions shall become effective upon expiry of 7 days as of the date on which the amended Terms and Conditions are placed on the Website.
  2. The Seller shall inform the Customers of the Online Shop about any amendments in the Terms and Conditions by sending appropriate information at Customer’s e-mail address. Shall the Customer not accept the new amendments in the Terms and Conditions, he/she is obliged to inform the Seller before the Terms and Conditions before the Terms and Conditions become effective. Shall the Customer not accept the new amendments in the Terms and Conditions it is necessary to de-register the Customer from the Online Shop. Shall the Customer not inform the Seller about the fact that the new amendments are not accepted by the Customer, the Seller considers the new Terms and Conditions accepted.
  3. Terms and Conditions may be printed, storaged or downloaded from the Seller’s Website.
  4. Shall the dispute appear, the parties shall endeavour to settle the dispute amicably. In the absence of an amicable settlement the case shall be referred to a court having an appropriate jurisdiction.
  5. All disputes are exclusively subject to Polish law.
  6. In unsettled matters in these Terms and Conditions shall be governed by the generally binding provisions of law.
  7. These Terms and Conditions are an integral part of the sale Contracts concluded by the Seller and the Customer.

8.2.   Appendix No. 2 - information on the specific risks linked to using the ecommerce services and the function and purpose of the software or data not covered by the Services;(in Polish)

8.3.   Appendix No. 3 - Withdrawal Form (Order Cancellation form)

  1. These Terms and Conditions shall enter into force on 18th June 2017.
